1. Acceptance of Terms
Welcome to GCPay. By accessing or using our services, you agree to comply with and be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our services.
2. Description of Services
GCPay provides a platform that connects Google Calendar with payment services to facilitate transactions between users ("Services"). The Services are provided solely as a tool for managing calendar events and associated payments.
"As Is" and "As Available" Disclaimer
THE SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT ANY WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR COURSE OF PERFORMANCE.
GCPay does not warrant that: (a) the Services will function uninterrupted, secure, or available at any particular time or location;
(b) any errors or defects will be corrected; (c) the Services are free of viruses or other harmful components; or (d) the results of using the Services will meet your requirements.
4. Payment Processing and Refunds
4.1. Third-Party Payment Processors. Our Services integrate with third-party payment processors including, but not limited to, Stripe, PayPal, and RozetkaPay. By using our Services, you acknowledge and agree that:
4.2. Refunds and Disputes. All payment disputes, refunds, and chargeback requests must be resolved directly through the respective payment processor's platform. GCPay is not responsible for processing refunds or resolving payment disputes between users.
- GCPay is not a payment processor and only provides the connection between you and third-party payment services.
- All payment processing, including charging funds, refunds, disputes, and other payment-related actions, are performed directly by the respective payment processors according to their own terms of service and privacy policies.
- You are fully responsible for managing your accounts with these payment processors, including accessing their dashboards for processing payments, refunds, and resolving disputes.
- GCPay does not control and is not responsible for the content, privacy policies, or practices of any third-party payment processors.
- All payment disputes, refunds, and chargeback requests must be resolved directly through the respective payment processor's platform. GCPay is not responsible for processing refunds or resolving payment disputes between users.
5. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, GCPAY, ITS DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, SUPPLIERS, OR AFFILIATES, SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:
- Your access to or use of or inability to access or use the Services;
- Any conduct or content of any third party on the Services;
- Any content obtained from the Services;
- Unauthorized access, use, or alteration of your transmissions or content.
6. User Responsibilities
You are responsible for providing accurate and complete information when using our Services, maintaining the security of your account credentials, all activities that occur under your account, complying with all applicable laws and regulations, managing your own payment processor accounts and dashboards, and resolving all customer service issues related to transactions processed through your payment accounts.
7. Indemnification
You agree to defend, indemnify, and hold harmless GCPay and its licensors, licensees, and their employees, contractors, agents, officers, and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees), resulting from your use of and access to the Services, your violation of any term of these Terms, your violation of any third-party right, including without limitation any copyright, property, or privacy right, any claim that your use of the Services caused damage to a third party, or any disputes between you and your customers regarding payments processed through third-party payment processors.
8. Termination
We may terminate or suspend your access to our Services immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms. All provisions of the Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.
9. Governing Law
These Terms shall be governed and construed in accordance with the laws applicable in the jurisdiction where GCPay is registered, without regard to its conflict of law provisions.
10. Changes to Terms
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material we will try to provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
